Property Rights Hell - Homeowner Associations

No, this isn’t about the subprime housing finance fiasco. It only relates in that some people are happy to let someone else pay for their responsibilities. This is about the dastardly institution known as the homeowners association. Mutual benefit corporations are formed and owners within a subdivision pay a membership fee for their equally shared benefits.

I bought a home in such an association five years ago. Okay, these arrangements are socialistic at best, but I wanted to be a good immigrant and go with the flow, as long as the association was meeting it’s obligations. We have 2 benefits in our association. 1. Use of the common owned recreation areas and 2. road maintenance. The Association claims 42% of our dues go to road maintenance.

So what is the problem, you ask? At our last yearly meeting, many of us were surprised to find out that only some of us actually get road maintenance. We purchased our land with the promise of ‘road maintenance’, often from a realtor who is a board member of the HOA. Half the roads in our rural community are paved and maintained by the county, not the HOA. The HOA only maintains gravel roads. This is a farce that has been perpetrated and kept quiet for decades. The original developer simply set up an HOA in order to force homeowners on county roads to pay for repairs on those on gravel roads, relieving the developer of his obligation. The board members, many with conflicts and on gravel roads have no intention of being fair about this situation.

At our yearly meeting, a motion was made to dissolve the corporation. The board, who by majority vote has the ability to dissolve the HOA, refuses. They also insist it takes 100% of the membership to dissolve the HOA. Not true, and the majority by survey has expressed the desire to dissolve.
NOTE: The law # 1900. (a) Any corporation may elect voluntarily to wind up and dissolve by the vote of shareholders holding shares representing 50 percent or more of the voting power.

(2) If the election [to dissolve] was made by the vote of shareholders, the
number of shares voting for the election and that the election was made by shareholders representing at least 50 percent of the voting power. See Calif. Code: http://law.justia.com/california/codes/corp.htm

HOAs are governed by the Attorney General’s office, who refuses to look at this, and by the Davis Sterling act. According to that law,

California code states 7132. (a) The articles of incorporation may set forth any or all of the following provisions, which shall not be effective unless expressly provided in the articles.
(3) The classes of members, if any, and if there are two or more classes, the rights, privileges, preferences, restrictions and conditions attaching to each class.


CORPORATIONS CODE SECTION 9330-9332
9330. A corporation may issue memberships having different rights, privileges, preferences, restrictions, or conditions, as authorized by its articles or bylaws.

9331. Except as provided in or authorized by the articles or bylaws, all memberships shall have the same rights, privileges, preferences, restrictions, and conditions.

Clearly, when there is only one class of membership, all members are afforded the same benefits for the same membership dues. This HOA is operating illegally.
Our HOA bylaws:

The OA handbook states:
Ar. IV Section 2 Members pg. 18
The Association shall have but ONE class of membership. Members shall be entitled ot one vote for each lot owned in the subdivision as hereinabove stated.

ART III Pg. 18 - The primary purpose of the Association is to own, promote, improve, and maintain the property of the Assoc. for the USE, pleasure, recreation, enjoyment of ALL of the members....In carrying out such purpose, the Assoc. shall be empowered to construct, repair, improve and maintain streets, roadways, and easements......

The mention of road maintenance: Articles of Incorporation 2.
(c) To maintain the roadways in said real estate development, including the access road to the main highway. (Note: all access roads are paved & maintained by county)

This ongoing deception is clear. Most of us get no benefit, but are forced to pay for those that do. The board considered dissolving if the owners on paved roads gave up their interest in the common areas in favor of gravel road owners getting the proceeds for future road maintenance, again outside boundaries of law.

As stated in the By Laws on page 31 Dissolution
"In the event of the dissolution of the Association, each member shall receive his pro rata portion of the Association's property and assets after all of its debts and liabilities have been paid or provided for."

THE LAW- 1362.
Unless the declaration otherwise provides, in a condominium project, or in a planned development in which the common areas are owned by the owners of the separate interests, the common areas are owned as tenants in common, in equal shares, one for each unit or lot.

-CORPORATIONS CODE SECTION 9680
(1) Except as provided in Section 6715, all of a corporation's assets shall be disposed of on dissolution in conformity with its articles or bylaws subject to complying with the provisions of any trust under which such assets are held.

If you have never had to deal with one of these associations, count your blessings. Those who have been using the rest of us to pay for maintenance of their property have no intention of letting go of this gravy train peacefully. I am reminded of the words of Ralph Waldo Emerson in 1838, who was dealing with a much more serious subject, but the sentiments are the same. Some property owners need to read Emerson on 'Self Reliance' as well.

Americans of Albanian heritage collected a million dollars in one evening for the presidential campaign of Republican Senator John McCain, said the Albanian American Civic League yesterday, the lobby group headed by former Congressman Joe DioGuardi. A reception for McCain was held January 22 at the Saint Regis Hotel in Manhatten, and the senator, who is now leading in the runoff for the Republican party candidacy in the November elections, cut his campaign in Florida by one day to attend this gathering.

"Even in 1998 when we had problems with Milosevic, McCain did everything that we asked of him to the benefit of the Albanian people, including arming the KLA", announced DioGuardi. "We are American Albanians and we need a leader who will strengthen this country... We must support John McCain because he did everything we asked of him for Kosovo, from supporting the Kosovo Liberation Army to supporting the independence of Kosovo. Two years ago he spoke in Brussels and said that independence is the only solution", concluded this former congressman who has been fighting for the independence of Kosovo and Metohija for more than twenty years.

He explained that the first thing McCain said to him when he entered the hotel in Manhatten on January 22: "Joe, I saw your people in Michigan, and in South Carolina and in New Hampshire", from which this lobbyist deduced that all Americans of Albanian background will be voting for the senator from Arizona.

DioGuardi and his wife Shirley Cloys-DioGuardi have been friends with McCain for years, and he intervened several times in the Senate on behalf of the Albanians. Because of that, the Albanian American Civic League awarded him the "Balkan Award for Peace" a year and a half ago, and the initiative was the proposed Senate resolution - which McCain wrote - in which thanks is extended to the Albanians for "saving all the Jews who lived in Albania or who sought shelter there during the Nazi Holocaust".

However, even though he is leading in the presidential nomination, John McCain has not yet succeeded in convincing the primary wing of the Republican Party - the conservatives - that he is the right candidate. One of the reasons is that he often spoke and voted against the majority Republicans, as in 1999 when he asked for more intensive air bombing of Serbia.

In April of that year, three weeks after the bombing commenced, he announced that the US is in danger of losing the war to the Serbian Army which has "antiquated machinery" and "absolutely no military air power", if massive strategic air attacks are not initiated. "Attacks on any infrastructure target must not be prevented. We all regret civilian losses, as well as our own, but they cannot be avoided," he said.

During the pre-election campaign in February 2000 at a meeting in Manhatten, John McCain asked for the release of all Albanian prisoners in the prisons of Serbia proper, and a year later he used his inlfuence to ask the administration for an urgent investigation into the killing of the brothers Bitici who were taken from prison and killed in the police training center in Petrovo Selo in eastern Serbia. This February 5 the senator held another meeting in Manhatten and in the public there was a visible Albanian flag.

As Sen. John McCain assumes the GOP front-runner mantle, his long-standing, but little-noticed association with left-wing donors such as George Soros and Teresa Heinz Kerry is receiving new attention among his Republican critics.

In 2001, McCain founded the Alexandria, Va.-based Reform Institute as a vehicle to receive funding from George Soros' Open Society Institute and Teresa Heinz Kerry's Tides Foundation and several other prominent non-profit organizations.

McCain used the institute to promote his political agenda and provide compensation to key campaign operatives between elections.

In 2006, the Arizona senator was forced to sever his formal ties with the Reform Institute after a controversial $200,000 contribution from Cablevision came to light. McCain solicited the donation for the Reform Institute using his membership on the Senate Committee on Commerce, Science, and Transportation. In a letter to the Federal Communications Commission, he supported Cablevision's push to introduce the more profitable al la carte pricing, rather than packages of TV programming.

Yet, the Reform Institute still employs the McCain campaign's Hispanic outreach director, Juan Hernandez, as a senior fellow of its Comprehensive Immigration Reform Initiative.

As WND reported, Hernandez serves as a non-paid volunteer for the McCain campaign (The salary comes instead from the Reform Institute and Soros’s money). A dual Mexican-U.S. citizen, he was a member of former President Vicente Fox's cabinet, representing an estimate 24 million Mexicans living abroad. Hernandez, with a "Mexico first" message, has argued aggressively against building a fence on the Mexican border, insisting the frontier needed to remain wide open so illegal immigrants could easily enter the U.S.

The July 6, 2001, homepage of the Reform Institute archived on the Internet lists founder McCain as chairman of the group's advisory committee.

Prominent senior officials on the McCain 2008 presidential campaign staff found generously paid positions at the Reform Institute following the senator's unsuccessful run for the White House in 2000.

Rick Davis, McCain's current campaign manager, was paid $110,000 a year by the Reform Institute for a consulting position, according to the group's 2003 Form 990 filing with the IRS.

In 2004, Davis advanced to the position of Reform Institute president, with an annual salary of $120,000, according to the group's 2004 Form 990.

In 2005, Davis remained president, but his salary dropped back to $45,000 a year, with a time commitment of five hours per week, according the 2005 Form 990.

Carla Eudy, a senior advisor on McCain's 2008 presidential campaign who until recently headed fundraising, was paid $177,885 in 2005 to serve as the Reform Institute's secretary-treasurer.

Other McCain presidential campaign staffers who have found employment at the Reform Institute include Trevor Potter, McCain's 2000 legal counsel, and Crystal Benton, the senator's former press secretary, who served as institute's communications director in 2005 for an annual salary of $52,083.

The Reform Institute regularly has supported McCain in various legislative efforts, including on campaign finance reform, global warming and "comprehensive immigration reform," all efforts widely opposed by many in the party's conservative base.

Arianna Huffington, syndicated columnist and creator of the HuffingtonPost.com, has served on the Reform Institute's advisory committee since the group's inception.

According to FrontPage Magazine, Teresa Heinz Kerry has provided more than $4 million to the Tides Foundation, a non-profit organization founded by anti-war activist Drummond Pike in 1976 with a history of funding causes such as abortion, homosexual-rights activism and open borders.

Financial contributors while McCain was chairman of the Reform Institute also have included the Educational Foundation of America, a group that supports abortion and opposes drilling in the Arctic National Wildlife Reserve.

The Soros-Kerry funding connection with McCain was first exposed by Ed Morrissey at the Captains Quarters blog in 2005.

Subsequently, David Horowitz's DiscoverTheNetworks.org website and Michelle Malkin's blog gave renewed attention to the Reform Institute's funding ties.

McCain is said to be resting up for a few days. He's certainly been scarce. Must be nice to be so confidant. Yes, he's missed doing his job in the Senate to campaign for years, as well.

One has to wonder if it all isn't about 'attitude'. Tonight, 60 Minutes gave 15 minutes each to Hillary and Obama. Nice exposure. Any candidate would jump at the chance. They invited McCain. McCain can certainly use all the help he can get, especially to counter the democrats, since he appears to be the republican nominee. He declined, saying he had 'scheduling conflicts'.

Funny, that , since he took the weekend off.

"In retrospect, McCain may have been saved by his campaign meltdown last summer, says Grover Norquist, another prominent conservative activist and president of Americans for Tax Reform. "Had he stayed the front runner, the talk-show hosts would have had the opportunity to make a case against him," Norquist says. But they didn't realize he was making a comeback until New Hampshire and South Carolina, and "by the time they tried to make a case, it was too late."

Hillary Hopes You’ve Forgotten - Have You?

Hillary Clinton has been telling America that she is the most qualified candidate for president based on her “record,” which she says includes her eight years in the White House as First Lady - or “co-president” - and her seven years in the Senate. Here is a reminder of what that record includes:

HILLARY, As First Lady, assumed authority over Health Care Reform, a process that cost the taxpayers over $13 million. She told both Bill Bradley and Pat Moynahan, key votes were needed to pass her legislation, that she would “demonize “anyone who opposed it. But it was opposed; she couldn’t even get it to a vote in a Congress controlled by her own party. (And in the next election, her party lost control of both the House and Senate.)

HILLARY assumed authority over selecting a female Attorney General. Her first two recommendations (Zoe Baird and Kimba Wood) were forced to withdraw their names from consideration, and then she chose Janet Reno. Janet Reno has since been described by Bill himself as “my worst mistake.”

HILLARY recommended Lani Guanier for head of the Civil Rights Commission. When Guanier’s radical views became known, her name had to be withdrawn.

HILLARY recommended her former law partners, Web Hubbell, Vince Foster, and William Kennedy for positions in the Justice Department, White House staff, and the Treasury, respectively. Hubbell was later imprisoned, Foster committed suicide, and Kennedy was forced to resign.

HILLARY also recommended a close friend of the Clintons, Craig Livingstone, for the position of director of White House security. When Livingstone was investigated for the improper access of up to 900 FBI files of Clinton enemies (Filegate) and the widespread use of drugs by White House staff, both Hillary and her husband denied knowing him. (FBI agent Dennis Sculimbrene confirmed in a Senate Judiciary Committee in 1996 both the drug use and Hillary’s involvement in hiring Livingstone. After that, the FBI closed its White House Liaison Office, after serving seven presidents for over thirty years.)

HILLARY, in order to open “slots” in the White House for her friends the Harry Thomasons (to whom millions of dollars in travel contracts could be awarded), had the entire staff of the White House Travel Office fired. They were reported to the FBI for “gross mismanagement” and their reputations ruined. After a thirty-month investigation, only one, Billy Dale, was charged with a crime - mixing personal money with White House funds when he cashed checks. The jury acquitted him in less than two hours.

HILLARY also assumed the duty of directing the “bimbo eruption squad” and scandal defense:

...She urged her husband not to settle the Paula Jones lawsuit.

...She refused to release the Whitewater documents, which led to the appointment of Ken Starr as Special Prosecutor. After $80 million dollars of taxpayer money was spent, Starr’s investigation led to Monica Lewinsky, which led to Bill lying about and later admitting his affairs.

...Then they had to settle with Paula Jones after all.

...And Bill lost his law license for lying to the grand jury.

...And Bill was impeached by the House.

...And Hillary almost got herself indicted for perjury and obstruction of justice (she avoided it mostly because she repeated, “I do not recall,” “I have no recollection,” and “I don’t know” 56 times under oath).

HILLARY accepted the traditional First Lady’s role of decorator of the White House at Christmas, but in a unique Hillary way. In 1994, for example, The First Lady’s Tree in the Blue Room (the focal point each year) was Decorated with drug paraphernalia, sex toys, and pornographic ornaments, all personally approved by Hillary as the invited artists’ depictions of the theme, “The Twelve Days of Christmas.”

HILLARY wrote “It Takes a Village,” demonstrating her socialist viewpoint.

HILLARY decided to seek election to the Senate in a state she had never lived in. Her husband pardoned FALN terrorists in order to get Latino support and the New Square Hassidim to get Jewish support. Hillary also had Bill pardon her brother’s clients, for a small fee, to get financial support.

HILLARY then left the White House, but later had to return $200,000 in White House furniture, china, and artwork she had stolen.

HILLARY played the “woman card” in the campaign for the Senate, by portraying her opponent (Lazio) as a bully picking on her
HILLARY’S husband further protected her by asking the National Archives to withhold from the public until 2012 many records of their time in the White House, including much of Hillary’s correspondence and her calendars. (There are ongoing lawsuits to force the release of those records.)

HILLARY, as the junior Senator from New York , passed no major legislation. She has deferred to the senior Senator (Schumer) to tend to the needs of New Yorkers, even on the hot issue of medical problems of workers involved in the cleanup of Ground Zero after 9/11.

Quite a resume, isn’t it?

Obama just got 90% in the Virgin Islands and a large majority in 3 states in the Democrat race.

I’m sorry, I can’t help being greatful to Barak Obama. He seems to be accomplishing something millions of Republicans have been trying to do for 30 years......... End the Clinton winning streak and make sure one of them never sits in the White House again!

Ya gotta love seeing her get beat. That’s what we have all been wanting, to see Hillary lose, isn't it?

Is that what they mean by be careful what you wish for?

And the Republicans? So far Huck is beating McCain in Louisiana and Kansas.

If there’s a way for Huckabee to mess this up for McCain, Hallelujah, brother! My chosen candidate certainly wasn’t able to.

Bill to improve health care…in Mexico! McCain strikes again!





What would Americans think, then, of a member of Congress who introduced legislation, not to improve health care in the United States, but to improve health care in Mexico?

Insane? Drunk? Unworthy of public office?

What would Americans think, then, of a bill introduced in Congress that required federal agencies to come up with a plan, not to expand health coverage in the United States, but to expand health coverage in Mexico?

Impossible? Unthinkable? Wildly irresponsible?

What would Americans think, then, of the motives of a senator, who not only introduced a bill to improve Mexico’s health care system and extend coverage to a growing population of 120 million people, but gave health insurance companies the right to help devise the plan?

Blatantly corrupt? Grossly indifferent to the well-being of the American people? Downright treasonous?

Unbelievable as it may seem, the Secure America and Orderly Immigration Act of 2005 contained a provision giving insurance companies the right to help devise a plan for extending US health care to Mexico (Sec. 1004. BINATIONAL PUBLIC HEALTH INFRASTRUCTURE AND HEALTH INSURANCE).

Even more unbelievable, the senator who sponsored the bill is not on the verge of being thrown out of office for this odious piece of legislation. No, the senator who introduced the bill, Senator John McCain of Arizona, is on the verge of locking up the Republican nomination to be our next president[snip]



Evidently our modern leaders just don't care about such notions as expressed by Lincoln above.

Fred Thompson and Sen. Thad Cochran have just endorsed McCain.

This is what Thad had to say just a few days ago. "The thought of his being president sends a cold chill down my spine"Sen. Doubting McCain (Did McCain leak classified info to WaPo re: CIA secret prisons?)

The WaPo editors who ran the front page headline story, CIA Holds Terror Suspects in Secret Prisons, on November 2, 2005 clearly should have been indicted for treason. There were immediate calls for Senate hearings to investigate the matter, which were then squashed by Senate Majority Leader Bill Frist.

That's because, as reported by the Capitol Hill newspaper The Hill, the leak was traced to a meeting of Republican Senators with no staffers present, during which the CIA secret prisons were discussed. The Hill then revealed:


"GOP aides conjectured privately that Frist's delay... may have been caused by concern over the possibility of endangering a Republican senator by calling for the investigation."

I soon learned - and told TTPers in To The Big House Instead of the White House? - that the "endangered senator" was John McCain.

Further, it's hard to trust a man who is drunk - not with booze but with his ego. A man ego-drunk past the 3rd stage of drunkenness, and into the 4th. [snip]

VOTE SMART OR DON’T VOTE AT ALL! or why we can't elect conservatives

Tonight my local CBS affiliate had a spot about the fact that the presidential candidates aren’t delivering voter information to the local party reps. The public is frustrated because they can’t get candidate/party literature to make their ‘informed’ vote. Give me a break! People don’t understand this is propaganda? Now let’s be serious, most voters don’t even go to that trouble. They may see a newscast that has shown only 4 candidates for the past month, or Colbert and Letterman. Yeah, like we need that vote! Ugh….

I’d say, after watching this current primary, there is an ineffective minority of us who actually vote based on a candidates record on issues or his/her (ack!) history. A famous dictator said, ‘It’s best for the leaders that the people are ignorant.’ Absurd outcomes of elections by electing the worst possible candidates don’t happen by accident. If people are not elected on their merits and ability to handle the job, why are they being elected? None of the answers are good.

Lets’ ignore the democrats for the moment. I don’t have the energy. John McCain is absolutely, without a doubt, the worst candidate running as a republican in this primary. The second worst is Mike Huckabee. Any of them, yes even Ron Paul would be better. Not that Paul is the answer, it’s just those two really are that bad.

We must find a way to increase the number of informed voters. I’m not talking about the people who vote out their childhood traumas….I’m poor…..I vote for the woman….I won’t vote for a Mormon….Mike Huckabee sounds like the fool I am….Tea will flow in Boston Harbor if Ron Paul is elected, .etc. Nothing can be done for them, they’ve existed before man voted and they’ll always be there to try to screw it all up for the rest of us. I’m talking about the good Americans out there who don’t go bonkers when you tell them something they don’t know. The ones who would vote intelligently if they could get the information.

They’re not on the internet, many don’t have cable, they read their local rag. They hang out with people who don’t know any more than they do. When you find how to reach them, you will solve the problem. We fall under the illusion that we are more informed than our ancestors. I’m not so sure. It was a hand delivered booklet carried over thousands of miles on horseback or foot that brought them the American Revolution. Those primitives elected George Washington, Thomas Jefferson….you know the routine…..ALL without TELEVISION! They could do it, but we can’t? That’s messed up.

Today I was contacted by 3 different groups all deciding they’re going to start a 3rd party by gosh! That’ll fix this mess! Oh……and how is anyone going to find out about these savior 3rd parties and their earthshaking ideas? CBS, CNN, FOX?…..Right! Thinking ‘party’ is what has us in this mess. If it has an ‘R’ beside it’s name, it must be all good! Yahoo! We’re all bent out of shape trying to defeat the Democrats --- Republicans can’t even defeat the Republicans in this election! We already have 2 parties that don’t function, we sure don’t need more. There are times for parties to grow, this isn’t one of them.

I got to show someone today ‘the real John McCain’ after she voted for him yesterday thinking they were electing a respected, conservative Senator and war hero. This person feels bad, real BAD! She read the ‘party’ literature and watches all the network news and reads a couple newspapers. But none of them are telling her the truth.

Think about this. The approval rating of congress is in the low 20’s. Eighty percent of the country thinks the House and Senate stink! The 3 ‘TOP’ candidates are all from the Senate, the slimiest elitist club ever known to man. Those three, McCain, Obama, and Hillary have been campaigning for the last 4 years instead of doing their job! Two of them are lawyers and that ought to disqualify them right off the bat. And McCain, well, he’s off the bat, too.

And someone wants to promote them? How does this make ANY sense?

Huckabee....Who loves ya, baby?

Mike Huckabee picked up a glowing character endorsement today.

From CBS Evening News, Feb. 4, 2008. "Mike Huckabee has been subjected to the millions of dollars of attack ads by Mitt Romney.....I think He's a very good and decent man and I admire him. And I admire his humor and I think he's elevated the entire presidential debate and campaign."

That was the answer given when Katie Couric asked what the shortcomings of Huckabee were. The answer was quite the contrast to the same question about Mitt Romney. And who was giving this praise to Huck?

JOHN McCAIN! He went on to attack Romney with the usual unqualified sound bites and insulted Rick Santorum as a 'defeated candidate' who had no right to question his temper.

Tell Senator McCain WE want Secured Borders.

Alert: Word of the appointment, made in November, spread across the Internet last night, sparking reaction from secure-border activists who charge Juan Hernandez's position in the campaign belies the Republican candidate's attempt to position himself as an advocate of border security.

McCain campaign spokesman Brian Rogers emphasized that Hernandez is "a non-paid volunteer to the campaign, and he does not play a policy role."

"Juan works with us to reach out to the Hispanic community to meet with the folks in the various states," Rogers said.

Asked if the McCain campaign has repudiated Hernandez's "Mexico first" declarations, Rogers did not give a direct answer.

Twice he referred to McCain's immigration position on the campaign presidential website arguing for border security.

In an appearance on ABC's Nightline in 2001, Hernandez said, referring to Mexican immigrants in the U.S., "I want the third generation, the seventh generation, I want them all to think 'Mexico first.'"

Hernandez told the Associated Press the same year, "I never knew the border as a limitation. I'd be delighted if all of us could come and go between these two marvelous countries."

Last August, Hernandez published a book entitled "The New American Pioneers: Why Are We Afraid of Mexican Immigrants?" in which he argued Mexican immigrants, both legal and illegal, were at the forefront of establishing a new North American market combining the U.S. with Mexico.

Mark Krikorian, director for the Center for Immigration Studies, asked last night on a National Review Online blog, "Has McCain offered Hernandez, a former high-level foreign government official who presumably swore an oath to uphold the Mexican constitution, a place on a future McCain Administration? That's not a rhetorical question."

Columnist Michelle Malkin posted equally critical comments this morning on her blog HotAir.com.

Noting that McCain has attempted to distance himself from the comprehensive immigration reform bill he co-sponsored with Democratic Sen. Ted Kennedy, Malkin said the appointment of Hernandez "tells me that John McCain is as weak on border security now as he ever was."

While McCain is now emphasizing border security, the policy posted on his website repeats many of the "flexible labor market" arguments advanced in the Kennedy-McCain comprehensive immigration reform bills, arguing for the necessity of a guest-worker program.

No fence

Hernandez has appeared on various cable news talk shows aggressively arguing against building any fence on the Mexican border, insisting the frontier need to remain wide open so illegal immigrants can easily cross into the U.S.

Hernandez was the first U.S.-born cabinet member to serve President Vicente Fox, operating from Los Pinos, the Mexican White House. Hernandez represented the 24 million Mexicans living abroad whom Fox then called "heroes" for representing Mexico in the foreign nations in which they lived.

In 1996, Hernandez was responsible for inviting Fox, then governor of the Mexican state of Guanajuanto, to speak at the University of Texas, Dallas, where he met George W. Bush, then governor of Texas, for the first time.

A lot has been made of Mitt Romney's 1994 positions on gay rights and abortion. We've heard the flip flop charge before. But what hasn't been well publicized is the following campaign flyer from 1994. Take a look below.

You can read the details of the flyer here and here. The mainstream media likes to run with the flip flop angle. There's validity to it but let's also be real here. It's a sexier story than one that shows how Romney's been a pretty consistent conservative for awhile.
